Division of powers and de-centralisation in the Latin American federations: characteristics and mode of operation

Abstract

This article assesses decentralization trends based on the analysis of the division of powers and the reasons for it. Its reference is the spectrum of mutation from dual federalism to administrative federalism. The methodology is mixed: qualitative and quantitative. Brazil is a proto-administrative federation that aspires to eradicate territorial imbalances, demonstrates superintendence, supervision and consensus of implementation. Argentina is a hybrid federation that mutated due to fiscal centralization motivated by the financial crisis; intolerance to supervision results in unlegislated discretionary implementation. Mexico is a hybrid federation founded on revolutionary transformations, registering an excess of coordinated functions in contrast to the vindication of dual performance and the implementation of adapted bilateralism.
